REFUND & RETURNS POLICY

This Refund & Returns Policy applies to purchases made through SBExplosive Athlete (“SBExplosive Athlete”, “we”, “us” or “our”) through sbexplosiveathlete.co.za (the “Website”).
We are committed to providing quality products and services and to treating our customers fairly. Nothing in this policy limits or excludes any consumer rights that cannot lawfully be limited or excluded under South African law, including applicable rights under the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).
1. Statutory Consumer Rights
Where applicable, consumers retain all rights provided to them by South African consumer-protection legislation.
For qualifying electronic transactions, ECTA provides a statutory cooling-off period of seven days for goods from receipt and for services from conclusion of the agreement, subject to the statutory exclusions. Where this right applies, a consumer may cancel without giving a reason and without penalty, subject to the requirements of the Act.
If a consumer exercises a statutory cancellation right, refunds will be processed in accordance with the applicable legislation.
Nothing in this policy is intended to remove, restrict or waive any statutory right available to a consumer.
2. Physical Products
If you purchase a physical product from us, including training equipment or other merchandise, please inspect the product when you receive it.
If your product is:

damaged when delivered;

materially different from what was advertised; or

otherwise does not meet the standards required by applicable law,
please contact us as soon as reasonably possible with your order number and details of the problem.
Where applicable, we will provide the remedy required by South African law, which may include a repair, replacement or refund.
The CPA provides consumer protections relating to the quality, suitability and performance of goods and services.
3. Change-of-Mind Returns
Where a statutory cooling-off or other legal right does not apply, refunds or returns for change-of-mind purchases will be considered in accordance with the individual product's stated return conditions.
Nothing in this section limits a consumer's statutory rights.
4. Digital Products and Training Programmes
Digital products may include:

training programmes;

downloadable programmes;

e-books;
-
training guides;
-
online resources;
-
video content; and
-
other electronically delivered products.
Because digital products can be accessed or downloaded electronically, you should carefully review the product description before purchasing.
Where a statutory cancellation or refund right applies, we will honour that right.
Where permitted by law, a discretionary refund may be refused where a digital product has already been fully delivered, accessed or downloaded and the applicable statutory cancellation right does not apply.
This does not affect any rights you may have where the digital product is defective, materially different from its description, or otherwise fails to comply with applicable consumer-protection law.
5. Coaching, Training and Other Services
For coaching, training, consultation or other services, cancellation and refund rights will depend on the nature of the service, the agreement between you and SBExplosive Athlete, the timing of the cancellation and applicable South African law.
Where a service has already commenced with the consumer's consent, statutory cooling-off rights may be affected by the provisions of ECTA.
If a service is not provided as agreed, we will seek to remedy the issue or provide another remedy where required by law.
6. How to Request a Refund

7. Refund Processing
Where a refund is approved or legally required, the refund will generally be made using the original payment method where reasonably possible.
The time it takes for the refund to appear in your account may depend on your payment provider or financial institution.
Where legislation prescribes a specific refund period, we will comply with that period.
For example, ECTA provides that where its seven-day cooling-off right is exercised after payment, the refund must be made within 30 days of cancellation.
9. Refunds for Promotions and Discounted Products
Products purchased during promotions, sales or using discount codes remain subject to the same statutory consumer rights that apply to ordinary purchases.
Any additional promotional refund conditions will be communicated at the time of purchase.
10. Fraudulent or Unauthorised Transactions
If you believe that a transaction was made fraudulently or without your authorisation, contact us immediately.
We may request information necessary to investigate the transaction and may work with the relevant payment provider where appropriate.
